Terms of Service
Borrow It Party Rentals

Welcome to Borrow It Party Rentals. By booking, reserving, or using any equipment or services offered by Borrow It Party Rentals ("Company," "we," "us," or "our"), you ("Renter" or "you") agree to be bound by the following Terms of Service. Please read them carefully before completing a booking.
1. Services Provided
Borrow It Party Rentals is a DIY party equipment rental business based in Fountain, Colorado. We provide short-term rentals of party and concession equipment including, but not limited to, concession machines, game sets, foam machines, and related accessories. All rentals are porch pickup and self-service — no delivery or staffing is included unless separately agreed in writing.
2. Reservations & Booking
A reservation is not confirmed until:
• A signed Rental Agreement has been received by the Company.
• The required 50% booking deposit has been paid.
The remaining balance and any required security deposit must be paid in full prior to equipment pickup. We reserve the right to cancel an unconfirmed reservation if payment or documentation is not received within a reasonable time.
3. Rental Period & Late Returns
The rental period begins when equipment is picked up and ends when it is returned, inspected, and accepted by the Company. Weekend rentals include Friday evening pickup and Monday return unless otherwise agreed in writing.
Late return fees apply as follows:
• $25 for the first 24 hours late.
• $50 per calendar day or partial day after the first 24 hours.
• Equipment not returned within 72 hours may be considered lost and charged at full replacement value.
4. Security Deposits
Security deposits are required for most rentals and vary by equipment type. Deposits are refunded within five (5) business days after equipment is returned, inspected, and confirmed clean, undamaged, and complete. The Company reserves the right to deduct from the deposit any applicable late fees, cleaning fees, damage charges, or replacement costs.
Important: If damages or costs exceed the security deposit amount, Renter agrees to pay the remaining balance.
5. Cancellation Policy
• 21 or more days before event: Full rental payment refunded, including booking deposit.
• 15 to 20 days before event: 50% of total rental payment refunded.
• 14 days or fewer before event: Rental payment is non-refundable.
Security deposits are fully refunded if equipment has not been released to the Renter.
6. Weather Policy
Outdoor rentals are weather-dependent. Light rain, typical seasonal weather, or unfavorable forecasts do not automatically qualify for cancellation or refund. In cases of severe weather — including but not limited to blizzards, lightning, or high wind advisories — the Company may, at its sole discretion, allow rescheduling based on availability. Refund determinations are made solely by the Company.
7. Renter Responsibilities
By completing a booking, Renter agrees to:
• Use all equipment only as intended and follow all provided safety and operating instructions.
• Return all equipment clean, dry, and in the same condition as received.
• Assume full responsibility for the safe setup, operation, and supervision of all rented equipment from pickup through return.
• Ensure adequate and safe electrical access at the event location where applicable.
• Not sublease, loan, or transfer equipment to any third party.
• Not modify, alter, or relocate equipment from the approved location without written permission.
• Provide direct adult supervision at all times when equipment is in use around minors.
8. Prohibited Uses
Equipment may not be used:
• Unlawfully or in any unsafe manner.
• Indoors unless specifically approved in writing by the Company (some equipment, such as the Volleyball/Badminton Combo Set, is approved for indoor use by design).
• In a commercial event without prior written approval from the Company.
• By anyone other than the Renter and their guests.
9. Damage, Loss & Cleaning
Renter is responsible for any damage, loss, or theft of equipment during the rental period. Cleaning fees apply if equipment is returned in unsatisfactory condition:
• Light cleaning: $25
• Heavy cleaning: $75
• Unsanitary or biohazard conditions: minimum $150 plus replacement if required.
The Company photographs all equipment before release and upon return. These records serve as evidence of condition.
Important: Renter authorizes the Company to charge the card on file for any applicable fees permitted under the Rental Agreement.
10. Assumption of Risk
Renter understands that use of rental equipment carries inherent risks. Renter voluntarily assumes all risks associated with possession and use of the equipment and accepts responsibility for all participants, guests, and invitees during the rental period.
11. Indemnification & Limitation of Liability
Renter agrees to indemnify and hold harmless Borrow It Party Rentals, its owners, and agents from any claims, damages, losses, liabilities, or legal expenses arising from the rental or use of equipment. The Company's total liability, if any, shall not exceed the total rental fees paid. The Company shall not be liable for incidental or consequential damages.
12. Force Majeure
The Company is not responsible for delays or cancellations caused by events beyond its control, including natural disasters, weather emergencies, or government restrictions. In such cases, payments will be applied as a credit toward a rescheduled date. If rescheduling is not possible within 90 days, a full refund will be issued. Security deposits are always fully refunded in force majeure cancellations.
13. Privacy
Your use of our website is also governed by our Privacy Policy, available at borrowitpartyrentals.com/privacy-policy. By using our services, you consent to the practices described therein.
14. Governing Law
These Terms of Service are governed by the laws of the State of Colorado. Any disputes arising under these terms shall be resolved in the appropriate courts of El Paso County, Colorado.
15. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
